1. About these terms

This site is operated by TutiBloom, 1021 E Lincolnway, Cheyenne, WY 82001, United States. Throughout the site, "we", "us" and "our" refer to TutiBloom. By visiting this site or placing an order you agree to these terms of service, together with our Shipping policy, Refund policy and Privacy policy, each of which is part of these terms.

If you do not agree with any part of these terms, please do not use this site or place an order.

2. Who may order

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use is your own or that you are authorised to use it.

3. What this product is

Tuti Palm is a cosmetic body-care device for home use. It is not a medical device, it is not FDA cleared, and it is not intended to diagnose, treat, cure or prevent any disease or condition. It is not a weight-loss device and it does not remove fat. Any statement on this site about firmer or smoother-looking skin describes appearance only. Individual results vary and no result is promised.

If you have a health concern about your body or skin, speak to a doctor rather than buying a cosmetic device.

4. Safety and correct use

Read the user guide before first use. Do not use Tuti Palm if you have a pacemaker, an implanted defibrillator or any other implanted electronic device; if you are pregnant or breastfeeding; if you have epilepsy; if you have a metal implant in the treatment area; if you have or have had cancer; if you have a heart condition; or if you have a fever, an active infection, a skin condition, an open wound or broken skin in the treatment area. Do not use on the head, face, neck, throat, genitals, or directly over the spine or heart.

Stop immediately if use causes pain, burning, dizziness or unusual skin reaction. Keep the device dry apart from the treatment surface, use only the supplied charger, and do not attempt to open or modify it. You are responsible for using the device as described in the user guide. We are not responsible for injury or damage caused by use that departs from those instructions.

5. Orders, prices and availability

All orders are an offer to buy and are subject to our acceptance. We may refuse or cancel any order, including after an order confirmation has been sent, where an item is out of stock, where a price or product description was published in error, where payment cannot be verified, or where we suspect fraud or resale. If we cancel a paid order we refund it in full.

Prices are shown in the currency selected at checkout and may change without notice. A discount shown on the site applies only while it is active and cannot be applied to an order already placed. We correct obvious pricing errors and are not obliged to sell at an erroneous price.

6. Payment

Payment is taken at checkout through Shopify and the payment providers shown there. We do not receive or store your full card details. You agree to provide accurate, complete purchase and account information.

7. Shipping, returns and refunds

Delivery estimates, duties and lost-parcel handling are set out in our Shipping policy. Returns, the 90-day window and refund timing are set out in our Refund policy. Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.

8. Warranty

Our Refund policy is your remedy for a device you are not satisfied with or that arrives damaged, incomplete or incorrect. Apart from that policy and any rights you have by law, the product is supplied "as is" and we give no other express warranty, including no warranty of merchantability or fitness for a particular purpose.

Some jurisdictions do not allow the exclusion of implied warranties or of statutory consumer guarantees. Nothing in these terms limits any right you have that cannot be limited by law.

9. Reviews and anything you send us

If you send us a review, photo, video, comment or suggestion, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish it in connection with our products, and you confirm that it is your own honest experience and that you have the right to share it. Do not send anything that is unlawful, defamatory, or that infringes someone else's rights. We may edit for length or refuse to publish, but we do not alter the substance of a review or publish a review in exchange for payment or a free product without disclosing it.

10. Acceptable use

You may not use this site for any unlawful purpose, to scrape or harvest data, to interfere with its security features, to introduce malicious code, or to resell our products as an authorised dealer without our written agreement.

11. Intellectual property

All text, images, video, product photography and site design are the property of TutiBloom unless otherwise credited, and may not be copied or reused without our written permission. Third-party names or marks on this site remain the property of their owners.

12. Third-party links and services

This site uses third-party services, including Shopify for hosting and payment. Links to third-party sites are provided for convenience and we are not responsible for their content, products or privacy practices.

13. Limitation of liability

To the fullest extent permitted by law, TutiBloom is not liable for indirect, incidental, special, consequential or punitive loss, including lost profits, arising from your use of this site or of the product. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

This section does not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

14. Errors and omissions

Content on this site may occasionally contain typographical errors or inaccuracies, or be out of date. We may correct or update it at any time without notice. We are not obliged to update information on this site except where the law requires it.

15. Changes to these terms

We may update these terms at any time. The version published here at the time you place an order is the version that applies to that order. Please check the date below before ordering.

16. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute that is not resolved between us will be brought in the state or federal courts located in Laramie County, Wyoming, and you and we consent to the jurisdiction of those courts. This does not remove any right you have to bring a claim in your own place of residence where consumer law gives you that right.

17. Severability

If any part of these terms is found unenforceable, that part is severed and the rest continues to apply.
